Review contracts with AI in 2026: how far it works, which tools, what it costs

AI can answer questions about a contract and summarize it. In a 2025 benchmark, specialist legal tools beat a lawyer baseline on document Q&A (top score 94.8% against 70.1%) but lost on redlining (65.0% against 79.7%). Legal research tools still hallucinated 17% to 33% of the time in a Stanford study, and in February 2026 a federal judge held that a defendant's chats with an AI tool were not privileged. Use AI as a first reader, not as your lawyer.

Where AI stands: Review contracts with AI · October 2026

As of October 2026, AI is ready to answer questions about a contract and summarize it, still early for extracting clauses and checking against your playbook, and not ready to redline, cite law or hold privileged material without a lawyer.

What works today

  1. 1

Proven Answer questions about a contract and summarize it: the top tools scored 94.8% on document Q&A and 77.2% on summaries, against lawyer baselines of 70.1% and 50.3%.

    Evidence

Vals Legal AI Report, 27 February 2025. Four specialist tools (Harvey, CoCounsel, Vincent AI, Oliver) against a lawyer baseline on seven tasks. Vendors opted in to tasks; results cover specialist legal tools, not general chatbots. Source ↗

  2. 2

Early Extract key data points such as parties, dates and clauses, at about lawyer level.

    Evidence

Same Vals report: data extraction scored 75.1% for Harvey and 73.2% for CoCounsel against 71.1% for lawyers, with margins of about 3 points, so the gap is small. Source ↗

  3. 3

Early Check a contract against your standard positions and flag deviations.

    Evidence

Vendor feature list: Spellbook describes Review, Compare and Playbooks tools in Word (page checked October 2026). No independent accuracy data was found, so treat flags as prompts for a lawyer. Source ↗

You upload the contract, AI flags clauses and risks, and a lawyer reviews before anyone signs.

What doesn't work yet

  1. 1

Can't Redline as well as a lawyer.

    Evidence

Vals Legal AI Report (February 2025): lawyers scored 79.7% on redlining against 65.0% for the top tool (Harvey) and 53.6% for Vincent AI. Redlining and EDGAR research were the two tasks where lawyers beat every AI tool. Source ↗

  2. 2

Can't Be trusted not to make things up, even with retrieval built in.

    Evidence

Magesh et al., Stanford RegLab, preregistered study (Journal of Empirical Legal Studies, 2025). Lexis+ AI, Westlaw AI-Assisted Research and Ask Practical Law AI each hallucinated between 17% and 33% of the time; vendors had claimed hallucinations were eliminated. Source ↗

  3. 3

Can't Keep your prompts and uploads privileged and confidential by default.

    Evidence

United States v. Heppner (S.D.N.Y., Judge Rakoff, 17 February 2026): a defendant's chats with Claude were not privileged, because the tool is not an attorney and its privacy policy allows data collection and disclosure. The judge suggested lawyer-directed use might differ. Source ↗

AI tools still make things up, lawyers beat AI at redlining, and chats may not be privileged.

Where to start

Founder or small business

Use an AI tool to summarize an agreement and list questions for your lawyer, and check any confidentiality clause before uploading the document.

In-house legal team

Pilot a specialist tool on one contract type, and compare its flags with your lawyers' on about 20 past contracts before trusting it.

Law firm

Follow ABA Formal Opinion 512: get informed client consent before inputting client information into self-learning tools, and verify every output.

Failure modes

  • Invented clauses, cases or citationsRetrieval-based legal research tools hallucinated 17% to 33% of the time in a preregistered Stanford study. Ask for the exact clause or section quoted, and open every cited clause, statute or case in the source before relying on it.Source
  • Sanctions for filing fabricated authoritiesA public database lists 2,098 court decisions in which a party relied on hallucinated content (as of October 2026). Never send or file AI-written legal text that a qualified person has not checked line by line.Source
  • Uploading a contract waives confidentiality or privilegeA federal court held AI chats unprivileged, and ABA Formal Opinion 512 asks lawyers to get informed client consent before inputting client information into self-learning tools. Use enterprise terms that bar training, have counsel direct AI use, and check confidentiality clauses before uploading.Source
  • Missed issues in redlines give false comfortLawyers beat every tested tool on redlining (79.7% against a top score of 65.0%). Have a lawyer review changes on anything material, and use AI to prepare questions rather than to approve terms.Source
